TERMS OF SERVICE, PAYMENT AUTHORIZATION, AND USER ACKNOWLEDGMENT

By accessing, using, or submitting information through this website, including submitting an application and/or payment, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service and Payment Authorization, Privacy Policy, and all related policies of FMCSA Processing Agent LLC, doing business as "#1 A $20 BOC-3 Filing LLC" ("Company").

If you do not agree to these terms and policies, you must not access, use, or purchase services through this website.

By submitting any application, information, documentation, or payment through this website, you represent, warrant, and agree as follows:

Acceptance of Terms

You acknowledge that you have been provided access to the Company's Terms of Service, Privacy Policy, Payment Policy, and related disclosures and have had a reasonable opportunity to review them before submitting information or payment. You agree to be legally bound by all such terms and policies.

Accuracy of Information

You represent and warrant that all information, statements, representations, and documents submitted by you are true, accurate, current, complete, and submitted in good faith. You understand that providing false, inaccurate, incomplete, misleading, or unauthorized information may result in delays, denial of services, cancellation of filings, additional fees, legal liability, or referral to appropriate governmental authorities where permitted or required by law.

Authority to Act

You represent and warrant that you are at least eighteen (18) years of age and possess the legal authority to enter into this agreement. If acting on behalf of a corporation, limited liability company, partnership, sole proprietorship, or other entity, you further represent and warrant that you have full authority to act on behalf of and bind such entity to these terms and to purchase the services requested.

Authorization of Payment

You represent and warrant that you are the lawful holder of, or authorized user of, the credit card, debit card, bank account, or other payment method provided. You authorize FMCSA Processing Agent LLC to charge the payment method submitted for all applicable fees, taxes, subscriptions, renewals, service charges, filing fees, and other amounts associated with the services requested. You further represent and warrant that all billing and payment information provided is accurate, current, complete, and authorized for use in connection with this transaction.

No Government Affiliation

You acknowledge and agree that FMCSA Processing Agent LLC is a private, independent filing and processing service and is not a federal, state, or local government agency. Fees paid to the Company are for filing assistance, registered agent services, processing services, subscription services, and related administrative services. The Company does not guarantee governmental approval, issuance of operating authority, regulatory compliance, processing times, or any specific outcome.

Refund and Cancellation Policy

You acknowledge and agree that all fees paid for BOC-3 filings, processing services, subscription services, registered agent services, and related administrative services are subject to the Company's Refund Policy. To the fullest extent permitted by applicable law, services that have been initiated, processed, submitted, filed, performed, or otherwise rendered are non-refundable. Once payment has been processed and services have commenced, you may not be entitled to a refund, credit, reversal, or cancellation except as expressly provided in the Company's Refund Policy or as required by law.

Chargeback and Payment Disputes

You agree to contact the Company and make a good-faith effort to resolve any billing or service concerns before initiating a chargeback, payment dispute, or payment reversal. If a chargeback or payment dispute is initiated and the Company successfully demonstrates that the charge was authorized and valid, you agree to reimburse the Company for any chargeback fees, administrative costs, collection expenses, reasonable attorneys' fees, and other costs incurred in defending or recovering such amounts, to the extent permitted by applicable law. Nothing in this agreement shall be construed as limiting any rights that cannot be waived under applicable law or payment network rules.

Indemnification

You agree to indemnify, defend, and hold harmless FMCSA Processing Agent LLC, its owners, officers, employees, contractors, agents, affiliates, successors, and assigns from and against any claims, liabilities, losses, damages, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to: (1) any false, inaccurate, incomplete, misleading, or unauthorized information submitted by you; (2) your violation of these terms or applicable law; (3) your unauthorized use of any payment method; (4) any dispute regarding your authority to act on behalf of an individual or business entity; or (5) any chargeback, payment dispute, or claim arising from a transaction authorized by you.

Electronic Signature and Consent

By clicking any button indicating acceptance, submission, authorization, purchase, payment, or similar action, you consent to conduct business electronically and acknowledge that your electronic action constitutes your electronic signature. You agree that your electronic signature is legally binding and has the same force and effect as a handwritten signature pursuant to the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), the Uniform Electronic Transactions Act (UETA), and other applicable laws.

Formation of Binding Agreement

A legally binding agreement between you and FMCSA Processing Agent LLC is formed upon your submission of an application, purchase of services, or submission of payment through this website.

By proceeding with your application and payment, you acknowledge that you have read, understood, and voluntarily agree to all terms contained herein, as well as the Company's Privacy Policy and any other policies incorporated by reference.
