By accessing or using this website and submitting an application and/or payment, you acknowledge that you have read, understood, and expressly agree to be bound by the Terms of Service and Privacy Policy of FMCSA Processing Agent LLC (#1 A $20 BOC-3 Filing LLC).

If you do not agree to the Terms of Service, the Privacy Policy, or the manner in which our services are provided, you must not access, use, or engage this website or our services.

By proceeding with and submitting any application, information, documentation, or payment through this website, you further represent, warrant, and certify under penalty of perjury that all information provided by you is true, accurate, complete, current, and not misleading to the best of your knowledge and belief.

You further represent, warrant, and certify under penalty of perjury that:

1. Receipt of Policies: You have been provided with, and have had the opportunity to review, the Terms of Service, Privacy Policy, and Payment Policy prior to submitting any information or payment.

2. Acknowledgment and Agreement: You have read, understand, and agree to be legally bound by the Terms of Service, Privacy Policy, and all related policies in their entirety.

3. Accuracy of Information: All information, representations, statements, and documents submitted through this website are true, correct, complete, and submitted in good faith. You understand that providing false, inaccurate, incomplete, or misleading information may result in delays, denial of services, cancellation of filings, legal liability, or referral to appropriate governmental authorities.

4. Authority to Agree: You represent and warrant that you are authorized, either in your individual capacity or as an authorized representative of a company, organization, or other legal entity, to accept the Terms of Service, provide information pursuant thereto, and bind such individual or entity to these Terms.

5. Indemnification for Misrepresentation: You agree to indemnify, defend, and hold harmless FMCSA Processing Agent LLC from and against any claims, losses, liabilities, damages, costs, or expenses arising out of or related to any false, inaccurate, misleading, or unauthorized representations made by you.

6. Formation of Binding Agreement: By submitting an application and/or payment through this website, a legally binding agreement is formed between you and FMCSA Processing Agent LLC (#1 A $20 BOC-3 Filing LLC), governed by and subject to the Terms of Service and related policies.

PAYMENT AUTHORIZATION AND CREDIT CARD AGREEMENT

By submitting your payment information and authorizing payment through this website, you represent, warrant, acknowledge, and certify the following:

1. Accuracy of Information: Under penalty of perjury pursuant to the laws of the United States of America, you certify that all information provided by you in this application and payment form, including billing and payment information, is true, accurate, current, and complete.

2. Authorization to Use Payment Method: You represent and warrant that you are the lawful cardholder or an authorized user of the credit card or payment method submitted, and that you are fully authorized to approve and incur charges for the services requested. You further authorize FMCSA Processing Agent LLC to charge the payment method provided for all applicable fees associated with the requested services.

3. Authority to Act and Indemnification: You represent and warrant that you are duly authorized, either in your individual capacity or as an authorized representative of a company, organization, or other legal entity, to submit the payment information provided and to bind such individual or entity to this agreement. You agree to indemnify, defend, and hold harmless FMCSA Processing Agent LLC from and against any claims, chargebacks, disputes, losses, liabilities, damages, costs, or expenses arising out of or related to any false, inaccurate, fraudulent, or unauthorized representations or payment submissions made by you.

4. Subscription Authorization and Automatic Renewal: You acknowledge and understand that the BOC-3 service is provided on a subscription basis and includes an automatic annual service fee of $20.00, which will be charged every twelve (12) months to the payment method provided. By submitting your payment information, you expressly authorize FMCSA Processing Agent LLC to initiate all current and future recurring charges associated with the BOC-3 service to the payment method on file unless and until the service is properly canceled in accordance with our cancellation policy and procedures.

5. Final Sale and No-Refund Policy: You acknowledge and agree that all charges related to the BOC-3 filing, subscription services, processing fees, and associated services are final and non-refundable. No refunds, credits, reversals, or chargebacks, whether partial or full, will be issued once payment has been processed, regardless of usage, duration of service, or subsequent cancellation.

6. Electronic Consent and Binding Agreement: By submitting your payment information and clicking the payment or submission button, you acknowledge that your electronic submission constitutes your legally binding electronic signature and agreement to these payment terms, the Terms of Service, Privacy Policy, and all related policies of FMCSA Processing Agent LLC.
