Secure BOC-3 Filing Application

By accessing or using this website and by submitting an application, documentation, information, and/or payment, you acknowledge that you have read, understood, and expressly agree to be legally bound by the Terms of Service, Privacy Policy, Payment Policy, and this Payment Authorization and Credit Card Agreement (collectively, the "Agreement") of FMCSA Processing Agent LLC, doing business as #1 A $20 BOC-3 Filing LLC ("FMCSA Processing Agent LLC").

If you do not agree to this Agreement or to the manner in which our services are provided, you must not access, use, or engage this website or purchase any services offered by FMCSA Processing Agent LLC.

By proceeding with your application and/or payment, you represent, warrant, acknowledge, and certify under penalty of perjury under the laws of the United States of America that:

1. Receipt and Review of Policies

You have received, or have been provided access to, the Terms of Service, Privacy Policy, Payment Policy, and this Agreement before submitting any application, information, documentation, or payment. You have had a reasonable opportunity to review these documents in their entirety.

2. Acceptance of Agreement

You have read, understand, and voluntarily agree to be legally bound by this Agreement, including the Terms of Service, Privacy Policy, Payment Policy, cancellation policy, refund policy, recurring billing authorization, and all other applicable policies governing the services provided by FMCSA Processing Agent LLC.

3. Accuracy of Information

All information, representations, statements, documentation, billing information, and payment information submitted by you are true, accurate, current, complete, and provided in good faith. You understand that providing false, inaccurate, incomplete, misleading, or fraudulent information may result in delays, denial of services, cancellation of filings, termination of services, legal liability, collection efforts, and/or referral to appropriate governmental authorities.

4. Authority to Act

You represent and warrant that you are either:

• acting on your own behalf; or
• a duly authorized owner, officer, member, manager, employee, or representative of the company or other legal entity for which services are being requested,

and that you possess full legal authority to submit this application, provide payment information, purchase the requested services, and legally bind yourself and/or the applicable individual or business entity to this Agreement.

5. Payment Authorization and Credit Card Agreement

You represent and warrant that you are the lawful cardholder or an authorized user of the credit card, debit card, or other payment method submitted.

You expressly authorize FMCSA Processing Agent LLC to charge the payment method provided for all applicable service fees, filing fees, subscription fees, renewal fees, late fees, processing fees, and any other charges authorized under this Agreement that become due for the requested services.

You further authorize FMCSA Processing Agent LLC to retain your payment information for future authorized charges in accordance with this Agreement unless prohibited by applicable law.

6. Subscription Authorization and Automatic Renewal

You acknowledge and understand that the BOC-3 service is provided on a subscription basis and includes an automatic annual service fee of $20.00, which will be charged every twelve (12) months to the payment method on file.

By submitting your payment information, you expressly authorize FMCSA Processing Agent LLC to initiate all current and future recurring charges associated with your BOC-3 subscription until the service has been properly canceled in accordance with this Agreement.

7. Cancellation Policy

You acknowledge and agree that cancellation of the BOC-3 subscription must strictly comply with the following procedures:

• Cancellation requests must be submitted in writing by email from the primary email address associated with your account.
• To be valid and effective, the written cancellation request must be received by FMCSA Processing Agent LLC no later than three (3) calendar days before your annual renewal or filing due date.
• Cancellation requests submitted by telephone, voicemail, text message, website contact forms, social media, or from any email address other than the primary email address on file shall not constitute valid notice unless expressly accepted in writing by FMCSA Processing Agent LLC.

If a valid cancellation request is not timely received, your subscription shall remain active, and FMCSA Processing Agent LLC shall be authorized to process your annual renewal, perform all applicable filing and representation services, and charge the applicable subscription fees and related service fees to the payment method on file.

You acknowledge and agree that you remain fully responsible for all charges associated with services performed, initiated, or renewed before the effective date of cancellation.

Any cancellation request received after the applicable deadline shall become effective only after completion of the current subscription period and shall not relieve you of any payment obligations incurred under this Agreement.

8. Final Sale and No-Refund Policy

You acknowledge and agree that all charges for BOC-3 filings, subscription services, processing fees, representation services, and all related services are final and non-refundable.

No refunds, credits, reversals, offsets, or chargebacks, whether partial or full, shall be issued once payment has been processed or services have been initiated, regardless of service usage, subsequent cancellation, business closure, revocation of operating authority, or any other circumstance unless otherwise expressly required by applicable law.

9. Indemnification

You agree to indemnify, defend, and hold harmless FMCSA Processing Agent LLC, its owners, officers, employees, affiliates, agents, and representatives from and against any and all claims, disputes, chargebacks, liabilities, losses, damages, judgments, penalties, costs, and expenses, including reasonable attorneys' fees, arising from or relating to:

• any false, inaccurate, misleading, incomplete, or fraudulent information provided by you;
• any unauthorized or improper use of a payment method;
• any misrepresentation of your authority to act on behalf of another individual or entity; or
• your breach of this Agreement.

10. Electronic Consent and Binding Agreement

By clicking the submission or payment button and submitting your application and/or payment, you acknowledge and agree that your electronic submission constitutes your legally binding electronic signature.

You further acknowledge and agree that:

• you intended to execute this Agreement electronically;
• your electronic signature has the same legal force and effect as a handwritten signature;
• this electronic acceptance creates a legally binding contract between you and FMCSA Processing Agent LLC; and
• you consent to conducting this transaction electronically in accordance with applicable federal and state laws governing electronic records and electronic signatures, including the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), where applicable.
